Linking to Websites
Before including a link to another web page the ideal situation would be that you are authorized by the owner of the web page to which you will direct your users. As this may not be viable in all cases, you should at least follow a series of guidelines to avoid legal problems. Firstly, you should review the terms and conditions of use of the web site you are linking to, that may already contain provisions with respect to the use of links to its content: in some cases they may forbid such links or allow them with or without conditions (e.g. many sites allow the use of text links to their content but require authorisation for the use of graphical links reproducing logos or trademarks).

Normally, web site owners allow links to their content as they imply that more traffic will be directed to their web sites. However, in some cases the use of direct links to such content may harm the owner of the web site economically. This may be because the normal access process is not followed (the owner may rely on this process for advertising income), because it may seem that the content belongs to the person who has inserted the link, or simply because it represents a non-authorized use of the content. In this sense, deep linking, which means the use of links that send the user directly to a specific content of another web site without passing through the main page, may be quite harmful for the web site owner. Therefore, secondly, it is best to make sure that the insertion of a link in your web page does not cause any significant harm to the owner of the other web site, avoiding, as far as possible, the use of deep links or, if appropriate, indicating to whom the content belongs.

Finally, you should also take into account that in some jurisdictions those linking to other people's content may be considered liable for the damage caused by such content if they have knowledge of the illegality or harmful nature of such content and they do not remove or disable the corresponding link. For this reason, although you do not have a general obligation of supervising the content to which you are linking, it is advisable to review this content periodically to avoid being considered responsible for such content. In any case, it is presumed that you have effective knowledge of the illegality of the content, if a competent authority has declared that such content is illegal.
